Public participation is an important part of any National Energy Board hearing.

Information provided by participants helps the NEB make decisions in the interest of all Canadians.

For all major pipeline hearings, the NEB must hear from anyone directly affected by a project and may hear from those who have relevant information or expertise.

To become a participant, you must apply to participate by submitting an online application form.

Each hearing has its own List of Issues. The List of Issues includes the topics that will be discussed during the hearing. When applying to participate, you will need to show how you are directly affected or how your information or expertise connects to the items listed on the List of Issues.

The NEB will review each application to participate and will decide who can participate and how.

When the Board reviews applications to participate, it considers the nature of your interest and how that interest may be affected by the project.

For example, if a project affects your property, employment or other commercial or financial interest, you could be considered directly affected.

You could also be directly affected if you are an Aboriginal person or group who uses land for traditional purposes.

The NEB may also hear from those who have relevant information or expertise.

For example, if you have local knowledge because you have lived in an area for a long time or if you have gained knowledge through study.

You must provide all the information the Board needs to decide who can participate.

If you don’t, you may not be allowed to participate.

For each major pipeline hearing, the NEB will announce when it will begin accepting applications to participate.

There are typically two ways you can participate in a hearing: as a Commenter or as an Intervenor.

If you participate as a Commenter, you share your views on the project with the Board in a written Letter of Comment.

As an Intervenor, you can ask questions, present evidence, answer questionsabout your evidence, and give a final argument. This  might be done orally or in writing.

When you are ready to submit an Application to Participate, go to the NEB’s website and find the webpage for the hearing you would like to participate in and locate the Application to Participate section. This will take you to the online form.

To begin, you will need to create an account. Once you’ve logged in, you are ready to complete the form.
When completing the form, you will be asked for basic information, including:
Your contact information,
Which official language you prefer to participate in,
Your preferred method of participation: either as a Commenter or Intervenor, and
How your interests are related to the List of Issues for the Project.

When you are ready to submit your application, simply click the “submit” button.

After the closing deadline, the Board will make its decision on participation and inform everyone who applied about whether or not they will be allowed to participate and how they may participate.
