Administrative Monetary Penalties Regulations
Background
The Administrative Monetary Penalties Regulations (Canadian Energy Regulator) (AMPs Regulations) are made under the Canadian Energy Regulator Act (CER Act). The CER Act came into force on 28 August 2019 and replaced the National Energy Board Act.
The AMPs Regulations set out the list of violations that are subject to Administrative Monetary Penalties (AMPs) under the CER Act, the method and criteria by which the penalty amounts will be determined, and the manner in which notices of violations must be served. The Regulator can impose financial penalties on companies or individuals for non-compliance with the CER Act, regulations, decisions, permits, orders, licences or certificate conditions intended to promote safety or environmental protection.
The AMP sections in the CER Act set out the maximum daily penalties for both individuals and companies. For individuals the maximum daily penalty is $25,000 for each violation, and for companies the maximum daily penalty is $100,000 per violation. The CER Act stipulates that each day that a violation continues is considered to be a separate violation. This means that separate penalties could be issued per infraction, per day with no maximum total financial penalty.
