Inspection Officer Order MJS-001-2024 issued to Algoma Orchards

On December 20, 2024, a CER Inspection Officer issued an Inspection Officer Order to Algoma Orchards, a third-party business that operates an apple orchard near Bowmanville, Ontario. The Order was issued after reviewing reports alleging that Algoma Orchards was not complying with Damage Prevention Regulations when working near a CER-regulated pipeline. The CER determined that Algoma Orchards and its contractors conducted the following activities:
- Installed steel anchors to a depth of 48 inches within the prescribed area.
- Drove trucks that exceeded the weight authorized by Trans Northern Pipeline Inc. (TNPI) across the pipeline.
- Stored topsoil over the pipeline.
- Violated conditions set out in TNPI’s written consent when working near the pipeline.
The Inspection Officer Order to Algoma Orchards requires the business to:
- Develop and implement a written safety procedure for working near federally regulated pipelines that incorporate CER regulatory requirements by January 31, 2025.
- Ensure Algoma Orchards employees and contractors understand and comply with the conditions set out in the written consent of federally regulated pipeline companies.
- Submit a written description to the CER detailing how it will ensure the full and successful implementation of the safety procedures in its operations by January 31, 2025.
We will continue to follow up with Algoma Orchards to ensure it complies with the Inspection Officer Order.
