TGS NOPEC Geophysical Company ASA, Petroleum Geoservices and MultiKlient Invest (TGS/PGS/MKI) NorthEastern Canada 2D Seismic Exploration Survey (the Project) – Request for Consent

The Canadian Environmental Assessment Act (CEA Act) has recently been repealed and replaced with the Canadian Environmental Assessment Act, 2012 (CEA Act 2012). The Project is not captured by the CEA Act 2012, or the transitional provisions. However, as part of its mandate under the Canada Oil and Gas Operations Act (COGOA), the Board assesses potential environmental impacts of projects and activities. Accordingly, the Board will continue its environmental assessment of the Project under the COGOA.

The environmental assessment process for the Project is well underway. To date, all filings related to the Project’s environmental assessment have been posted on the public registry on the NEB website in accordance with the CEA Act. Despite the legislative changes, the Board wishes to continue public participation in the Project’s environmental assessment process.

Generally, material filed under the COGOA is privileged and must not be disclosed without the written consent of the person who provided it. To ensure compliance with subsection 101(2.1) of the Canada Petroleum Resources Act, the Board is requesting the consent of TGS/PGS/MKI to disclose any new or additional information about the Project’s environmental assessment. If TGS/PGS/MKI is agreeable to providing its consent, please sign and return the attached Consent to Disclosure form to Kyle Sherwin, Team Leader of Conservation of Resources by 16 July 2012. Such consent will enable the Board to: (i) post new filings related to the Project’s environmental assessment on the public registry; and (ii) conduct community meetings to gather oral comments about the draft environmental assessment report.
