Nig Creek Pipeline Rupture, Leave for Return to Service Application dated 7 September 2012

The National Energy Board, having considered the above-referenced application, has issued Order SG-W102-001-2012 granting leave to return the Nig Creek Pipeline to service with conditions. A copy of the Order is attached.

ORDER SG-W102-001-2012

IN THE MATTER OF the National Energy Board Act (the Act) and the regulations made thereunder, and

IN THE MATTER OF an application by Westcoast Energy Inc., carrying on business as Spectra Energy Transmission (Westcoast) to return the Nig Creek Pipeline to Service following a rupture, filed with the National Energy Board under File OF-Surv-Inc-2012 81.

BEFORE the Board on 17 September 2012.

WHEREAS the Board issued a letter dated 14 August 2012 approving Westcoast’s Return to Service Plan and directing Westcoast to apply for leave to return the Nig Creek Pipeline to service;

AND WHEREAS Westcoast has filed an application dated 7 September 2012 for leave to return the Nig Creek Pipeline to service;

AND WHEREAS the Transportation Safety Board of Canada (TSB) is also conducting a Level 3 investigation into the events leading to the failure;

AND WHEREAS the Board has examined Westcoast’s application and is satisfied that the Nig Creek Pipeline may be safely reopened for the transmission of sour natural gas;

AND WHEREAS the Board is of the view that ongoing monitoring of the Nig Creek Pipeline is necessary to ensure the continued fitness for service of the pipeline;

NOW THEREFORE, pursuant to section 48 of the Act the Board hereby orders the following:

  1. estcoast is granted leave to return the Nig Creek Pipeline to service at a maximum operating pressure of 6 895 kPa.
  2. Within 30 days of the return to service of the Nig Creek Pipeline, Westcoast shall submit to the Board a plan for the ongoing monitoring and verification of the pipeline’s fitness for service (Monitoring Plan).
  3. Within 30 days of the issuance of the final TSB investigation report, Westcoast shall submit to the Board an updated Monitoring Plan which incorporates findings of the TSB investigation as appropriate.
