Open comment period on proposed CER regulations

The Canada Energy Regulator (CER) is updating its export and import regulatory framework.

You are invited to provide feedback on five proposed regulations related to export and import processes. The comment period is open for 45 days and will remain active until January 28, 2025. This opportunity allows Indigenous Peoples, companies and other interested parties to review and provide feedback on the proposed regulations.

The proposed regulations have been pre-published in Canada Gazette, Part I, and include:

The five proposed regulations have been developed to replace four current regulations:

  • National Energy Board Part VI (Oil and Gas) Regulations
  • National Energy Board Electricity Regulations
  • National Energy Board Export and Import Regulations
  • Toll Information Regulations

These proposed regulations will reflect the transition from the National Energy Board Act (NEB Act) to the Canadian Energy Regulator Act (CER Act) in August 2019. The proposed regulations reproduce sections found in the current NEB Act regulations and incorporate updates to align with the CER Act and increase clarity. While the proposed regulations will simplify procedures, particularly for companies involved in export applications, they will also streamline reporting requirements. The updates to the proposed regulations are primarily administrative and would provide a clear, consistent, and predictable regulatory environment.
