Requested Amendment to the National Energy Board Cost Recovery Regulations (Regulation)

The National Energy Board received a letter dated 1 June 2010 from ExxonMobil Canada and Encana Corporation requesting an amendment to the Regulation. The request is to amend the threshold values that define large and intermediate gas pipeline companies. A copy of the letter is attached.

Under the current Regulation, a "small gas pipeline company" is a person or company whose combined annual cost of service (annual cost) is less than $1,000,000; an "intermediate gas pipeline company" is one whose annual cost is $1,000,000 or more, but less than $10,000,000; and a “large gas pipeline company” is one whose annual cost is $10,000,000 or more.

The Board has been asked to amend the Regulation to change the threshold value for an "intermediate gas pipeline company" to one whose annual cost is $1,000,000 or more, but less than $60,000,000; and a "large gas pipeline company” "o one whose annual cost is $60,000,000 or more.

The Board is seeking input on this request. Specifically, the Board would like input on:

• whether the threshold values in the Regulation for intermediate and large gas pipeline companies should be amended, and
• if the thresholds were to be amended, the appropriateness of the values proposed by Exxon Mobil Canada and Encana Corporation
